Answer the following question.
- Please discuss both the positive and negative consequences/impacts of sentencing guidelines. Do the benefits appear to outweigh the drawbacks? Why/why not? Note: Sentencing guidelines (for one example, see Figure 7.1 in the textbook) are a specific set of rules, not any sentencing law. The key to this question is to understand what sentencing guidelines intend to do, and how the rules differ from pre-guideline rules.
- Please discuss, one by one, whether the death penalty serves the goals of retribution, deterrence, incapacitation, rehabilitation, and restoration. Then in conjunction with these goals, please briefly discuss whether the benefits of the death penalty appear to exceed the costs.
- We often talk about “the court system,” but the different courtroom actors and courts do not always work in a unified way, which led to some people questioning whether the courts are indeed one system. Please discuss both sides of the argument–evidence suggesting that courts indeed function as a system, and evidence suggesting that courts are a scattered set of moving parts that do not necessarily function together. What is your view on this? Is the evidence for one side stronger than the other?
- Discuss the appellate process from trial to the U.S. Supreme Court. Distinguish between direct appeals and habeas corpus proceedings or interlocutory appeals.
- Does the current evidence suggest problem-solving courts add to traditional courts? Are there any other specialized courts you would propose? Why?
